By accessing or using the website located at https://seaviewwd.com (the “Site”) and any related services, sales channels, or mobile applications (collectively, the “Service”), you agree to be bound by these Terms & Conditions (the “Terms”). If you do not agree, do not use the Service.

  1. Order Acceptance. All orders are subject to acceptance and availability. We reserve the right to refuse or cancel any order—for example, due to pricing errors or stock limitations.
  2. Pricing. Prices are listed in U.S. dollars and do not include taxes, shipping, or installation unless expressly stated.
  3. Payment Processing. Payments are handled by third-party processors; we do not store full credit-card numbers.

6. Shipping, Delivery & Risk of Loss

Title and risk of loss pass to you upon delivery to the carrier. Delivery dates are estimates and not guaranteed.

7. User-Generated Content

If you post reviews, photos, or other content (“UGC”), you grant Scenic Doors a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, publish, and distribute that UGC in any media. You represent that you own or control all rights to your UGC and that it does not violate the rights of any third party.

8. DMCA / Copyright Complaints

We respond to valid Digital Millennium Copyright Act (“DMCA”) takedown notices. Send notices to [dmca@scenicdoors.co] with the information required by 17 U.S.C. § 512.

9. Intellectual Property

All content on the Service—including text, graphics, logos, and product images—is the property of Scenic Doors or its licensors and is protected by U.S. and international copyright, trademark, and other laws.

10. Prohibited Uses

You agree not to:
  1. Engage in unlawful, fraudulent, or deceptive activities;
  2. Upload malicious code;
  3. Infringe on any intellectual-property or privacy rights;
  4. Circumvent security measures;
  5. Use automated means to access the Service without permission.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” EXCEPT AS EXPRESSLY STATED IN OUR WRITTEN WARRANTIES, WE DISCLAIM ALL WARRANTIES—EXPRESS OR IMPLIED—INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEAVIEW WINDOWS & DOORS AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY. Nothing in these Terms limits liability for gross negligence, intentional misconduct, or other liabilities that cannot be limited under applicable law (e.g., California Civil Code § 1668).

13. Indemnification

You agree to indemnify and hold harmless Scenic Doors, its officers, directors, employees, and agents from any claims arising out of your breach of these Terms or your misuse of the Service.

14. Governing Law & Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. You and Scenic Doors agree to submit to the exclusive jurisdiction of the state and federal courts located in Los Angelese, California. Either party may bring an individual action in small-claims court.

15. Changes to Terms

We may update these Terms from time to time. Material changes become effective 30 days after we post the revised Terms and update the “Last Updated” date above. Continued use of the Service after that date constitutes acceptance.

16. Severability & Waiver

If any provision is held unenforceable, the remaining provisions will remain in effect. Our failure to enforce any right does not waive it.

17. Entire Agreement

These Terms, together with the Privacy Policy, Cookie Notice, and any separate product-specific policies (e.g., Returns & Warranty), constitute the entire agreement between you and SeaView Windows & Doors regarding the Service and supersede all prior agreements.
